This Applicant Notice applies only to applicants who are residents of California and any terms not otherwise defined in this Applicant Notice are defined in the same manner set forth in California Civil Code Section 1798.140.

COLLECTION AND USE OF YOUR PERSONAL INFORMATION
Personal Information is any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, to you.
Specifically, we collect and process the following categories of Personal Information:
Information by which you may be personally identified, such as name, postal address, email address, telephone number, visual information (e.g., photograph, if provided), or other identifiers by which you may be contacted online or offline (“personal identifiers”);
Information that is demographic in nature, such as date of birth, gender, and marital status (“demographic information”);
Information should you provide it that is considered sensitive information, such as Social Security or other state identification number, geolocation, racial or ethnic origin, religious or philosophical beliefs, or union membership (“sensitive personal identifiers”);
Information that is about your professional history or experiences, such as your resume, cover letter, educational history, employment history, professional affiliations, role or title, company information and specialized certifications (“professional or employment-related information”); and
Information about your internet or other electronic network activity, such as IP address, location information based on the IP address, Internet connection, date and time of the server request, device and browser data, time zone, specific browser or app function, access status, amount of data transferred, log data, operating system used, and its interface (e.g., Android or IOS), language, version of the operating system, device identifiers, and other usage details (“internet or other electronic network activity information”).
When you apply for a position at EOS Worldwide, we collect or receive personal information at various stages in the application process as described below:
Complete an application: When you apply for a position with EOS Worldwide, we may collect from you your personal identifiers, your demographic, your sensitive personal identifiers, and your professional or employment-related information. We use this personal information to review your background and skills, determine your qualifications for the role you are applying for, and to confirm information related to your education. For equal employment and affirmative action purposes, you may also have the option to provide us with your protected classification information (i.e., gender, race, ethnicity, veteran status, and disability status) some of which is sensitive information. We may use this protected classification information for government reporting purposes, to comply with legal requirements related to hiring practices (for example, to create a record of the applicant’s process and confirm that our hiring practices are legal in the event of there is a question from the United States Equal Employment Opportunity Commission (EEOC) or the California Department of Labor), to analyze requested disability accommodations as applicable, and to maintain a record of things like accommodations we provided to address your needs.
Automated Processing: During our talent acquisition process, we may process your information through automated means (including the use of Artificial Intelligence) to increase our effectiveness and speed of review of your professional and employment related information. While these tools do help up in working through all the applicants we receive for our job openings, we do not rely solely on this kind of processing to determine the next steps for your application. We also may use this information to consider you for other jobs at EOS Worldwide which we think you might be interested in. Please note, should you want to opt-out of the use of AI for considering you for jobs you haven’t applied for, then you may opt-out of such processing using the process described “Your Rights” below.
Participate in an interview: We may conduct interviews in-person, telephonically or through video conferencing software (e.g., Zoom™). If you participate in an interview with EOS Worldwide, we may collect from you certain personal identifiers, demopraphic information and internet or other electronic network activity information. If we record a call or video, you will be informed before the call or video interview begins. For in-person interviews, we may also collect video recordings via CCTV systems on our premises. We use this information to conduct the interview, verify your identity, and to ensure the security of EOS Worldwide personnel and guests.
Information from references: When you provide references with your application, we may receive from your references your professional or employment-related information. We will use this information and make inferences from them, such as their thoughts on your behavior, intelligence, abilities, and aptitudes. An inference is essentially a characteristic deduced about an applicant that is based on other information collected. We use this personal information to assess your suitability for the position for which you have applied.
Responses to role-based aptitude and skills test: If you complete a role-based aptitude, skills, or personal assessment as part of our hiring process, we may collect the responses you provided from our third-party test administrator. We use your responses to draw inferences about your characteristics, intelligence, abilities, and aptitudes so that we can match you with jobs and determine your suitability for specific role(s). For example, EOS Worldwide receives information from your Kolbe™ assessment regarding how you may approach things at work (called your method of operation). We may use these results as one factor in a multifactor process of evaluating your potential employment.
LinkedIn. EOS Worldwide utilizes LinkedIn to recruit applicants for potential positions. We may collect from LinkedIn your personal identifiers, certain demographic information, your professional or employment-related information and any other information you provide on your LinkedIn profile page. We use this information to communicate with you about prospective job opportunities, to review your background and skills, determine your qualifications for the role you are applying to, and to confirm information related to your education.
Outside Recruiters. We utilize outside recruiting companies to help us find potential candidates for open positions within EOS Worldwide. We may collect from them your personal identifiers, your demographic information, your professional or employment-related information and any other information you provided to the recruiter that they may share with us. We may use this information to communicate with you about prospective job opportunities, to review your background and skills, determine your qualifications for the role you to which you are applying, and to confirm information related to your education.
If you get to the stage of the application process where a conditional offer is extended, we collect or receive the following personal information as described below:
Conduct a Background Check. If you get to the stage of the application process where a background check is necessary, our third-party background check provider will collect directly from you your personal identifiers, your demographic information, and your sensitive personal identifiers. EOS Worldwide receives a report from our third-party provider with the information they collected from their search performed according to local and state laws. Such information could include your personal identifiers, your demographic information, your sensitive personal identifiers, your professional or employment-related information and if it exists, your criminal history (e.g., police reports, criminal records).
Credit Check: If you apply for a role that requires us to complete a credit check, then if you get to the stage of the application process where we perform the credit check, our third-party credit check provider will collect directly from you your personal identifiers your demographic information, and your sensitive personal identifiers. EOS Worldwide receives a report from our third-party provider with the information they collected from their search performed according to local and state laws. Such information could include your personal identifiers, your demographic information, your sensitive personal identifiers, and your credit history. We use this information according to applicable local and state laws to verify your information, to comply with our internal policies, and to comply with regulatory requirements.
To the extent that you accept our offer for employment, then as part of your onboarding process, we will collect or receive and maintain your personal information as an employee of EOS Worldwide, including personal identifiers, demographic information, sensitive personal identifiers, professional or employment-related information and bank account information for payroll and expense reimbursement purposes.
INFORMATION SHARING
General Sharing:
EOS Worldwide may share applicant personal information in the following instances:
Within EOS Worldwide: We may share applicant personal information among our hiring decision-makers, affiliates, and other employees involved in the hiring process (i.e., human resources department, senior management, and other managers) for the legitimate business purposes of assessing applications and making hiring decisions.
With service providers: We may share applicant personal information with service providers that assist
us with application processes or provide us with employment related services. These service providers
include our background check providers, cloud storage providers, recruitment providers, talent
acquisition providers, and IT support providers.
For legal purposes: We may share applicant personal information with third parties, such as legal advisors, law enforcement agencies, or governmental/regulatory bodies in order to protect our legal interests and other rights, protect against fraud or other illegal activities, for risk management purposes, and to comply with legal obligations.
With Other Third Parties. We may need to disclose your personal information to third parties, such as legal advisors, law enforcement agencies, or governmental/regulatory bodies in order to comply with any court order, law, or legal process, including to respond to any government or regulatory request, to enforce or protect our legal interests and other rights under our agreements or otherwise, to protect against fraud or other illegal activities, prevent harm, for risk management purposes, and to comply with our legal obligations. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
In the Event of a Corporate Reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of both facilitating and completing the transaction and for the buyer’s operation of our businesses as a going concern following the completion of the transaction in which personal information held by us about our employees and job applicants is among the assets transferred. We would also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.
EOS Worldwide does not sell or share (as these terms are defined in the California Civil Code Section 1798.140) the personal information of applicants.
YOUR RIGHTS
The California Privacy Protection Act (CPPA) and the California Privacy Rights Act (CPRA) (collectively “CCPA/CPRA”) entitle California residents to certain rights (subject to exceptions). To the extent the CCPA/CPRA applies to our processing of your personal information, you are entitled to the following rights:
Right to Access/Know. You have the right to request what personal information we have collected, used, disclosed, shared and/or sold about you. Once we receive your request, confirm your identity, and confirm that no exceptions apply under applicable law, we will provide you with the requested information. You may only submit an access request twice within a twelve-month period. See below to learn how to exercise this right.
Right to Deletion. You have the right to request the deletion of your personal information that we collect from you, subject to certain exceptions, including but not limited to, to comply with federal and state labor laws, federal and state health laws, and the Department of Transportation requirements. Once we receive your request to delete, confirm your identity, and confirm that no exceptions apply under applicable law, we will delete (and direct any service providers or third parties, who we have shared your personal information to, to delete) your personal information, unless an exception applies under applicable law.
Right to Opt-Out of Sale/Sharing. You have the right to opt-out of the sale or sharing, as defined under the CCPA/CPRA, of your personal information to third parties. Again, however, EOS Worldwide does not sell personal information of applicants, nor does EOS Worldwide use cookies or similar tracking technologies for its application process. Further, EOS Worldwide does not have actual knowledge that it sells or shares personal information of individuals under the age of sixteen (16) years.
Right of Non-Discrimination. You have the right not receive discriminatory treatment for exercising your rights to access, delete, opt-out, correct, or limit use of sensitive personal information (as defined below) under the CCPA/CPRA.
Right to correct. You have the right to correct inaccurate personal information that we maintain about you.
Right to limit use of sensitive personal information. Sensitive personal information is defined under the CPRA as personal information that reveals (a) consumer’s Social Security or other state identification number; (b) a consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (c) consumer’s geolocation; (d) consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership; (e) the contents of a consumer’s mail, email, or text messages, unless the business is the intended recipient of the communication; and (f) consumer’s genetic data. Examples include, but are not limited to, driver’s license number, biometric information, and precise geolocation. EOS Worldwide does not use sensitive personal information collected from our applicants for any other purpose than what was originally intended. If EOS Worldwide was using your sensitive personal information in a manner inconsistent with the original purpose of collection, you would have the right to limit how we use and disclose your sensitive personal information to only what is necessary to perform specific business purposes for which it was collected or what is reasonably expected by the average applicant.
To exercise your right to access, correct, or delete your personal information, you may submit a request by emailing us at [email protected] or by contacting us toll-free at 877-367-1877. For requests submitted, you must provide us with sufficient information that allows us to reasonably verify your identity, as well as the right you are exercising. This information includes your name, email address, physical address, and please indicate the nature of your relationship with EOS Worldwide (i.e., job applicant). For email submissions, please write, “California Applicant Privacy Request,” in the subject of the email. The information you provide allows us to reasonably verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it. In doing so, we will take steps to verify your request by matching information provided by you with the information we have in our records. If we are not able to verify your identity for access and deletion requests with the information provided, we may ask you for additional pieces of information. Only you, or a person that you authorize to act on your behalf may make a request related to your personal information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual. Therefore, you do not need to exercise your right to opt-out of the sale or sharing of your personal information through cookies or other trackers.
In the event that we cannot fulfill your request to access, delete, correct, or limit the processing of your personal
information, we will provide you with a notice of such a denial. You may then appeal this decision by escalating
your request to our privacy office. You may make this appeal using the same email address or phone number you
used to make your initial request. For email submissions, please write, “California Privacy Appeal,” in the subject
of the email.
DO NOT TRACK
A Do Not Track (DNT) and Global Privacy Controls (GPC) are not widely recognized, we do not respond to DNT or GPC signals. These signals are triggered by a preference you can set in your web browser to inform Website and mobile applications that you do not want to be tracked.
TEXT MESSAGING AND AUTO-DIAL COMMUNICATIONS.
We may contact you by telephone or text message (including through the use of artificial voices, prerecorded voice messages and/or autodialed calls and text messages) to the telephone number you provide or to any number provided to us on your behalf, for various purposes including verifying your identity, providing you with important notices regarding your account or use of our services, fulfilling your requests or letting you know about promotions or other services we think we may be of interest to you. Your consent to receive automated calls and texts is completely voluntary, and you may opt out at any time. You acknowledge that if you do not opt out, we may contact you even if your number is listed on a do-not-call list or if you cancel your account or terminate your relationship with us. You do not have to agree to receive promotional calls or texts as a condition of purchasing any goods or services.
For any text messages sent to you in connection with the EOS Web Properties: (a) message frequency may vary, (b) message and data rates may apply, and we are not responsible for these charges, (c) you may reply HELP when available or contact us for information, (d) you can reply STOP when available or contact us to opt out at any time (though if you do, you agree to receive a single message confirming your opt-out) and (e) neither EOS Worldwide nor mobile carriers involved in the text messaging are liable for delayed or undelivered messages.
To opt out of text messaging or automated voice calls (other than as permitted through the service), you must provide us with written notice revoking your consent by contacting us as described below or in Section 12(f) of our General Terms of Use and including your full name and the specific phone number(s) you wish to opt out of such calls. You may continue to receive service-related text messages from other phone numbers managed by EOS Worldwide, and you may opt out of those in a similar fashion.
Without your consent, with the exception of originator opt-in data and consent information that may be shared in accordance with this Privacy Notice, no mobile information will be shared with or sold to third parties or affiliates or otherwise used for marketing or promotional purposes.
INFORMATION SECURITY
We may hold the information we have collected in paper and/or electronic form.
We implement and maintain reasonable security measures, such as access controls and encryption, to protect the personal information that we collect and maintain from accidental loss, unauthorized access, destruction, use, modification, or disclosure.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our EOS Web Properties or any third-party sites. No security measure or modality of data transmission is 100% secure, and we are unable to guarantee the absolute security of the personal information we have collected from you.
Therefore, any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our EOS Web Properties or through any third-party sites.
DATA RETENTION
We retain your personal information (i) for as long as necessary to fulfill the purposes for which the information was collected, or (ii) until we receive a valid request to delete the information, in which case, barring any exceptions, we will delete or anonymize the information within 30 days after receiving the request. However, we may need to use and retain your personal information for longer than the periods indicated above for purposes of:

We may amend this Applicant Notice in our sole discretion at any time. If we do, we will post the changes to this page, and will indicate the date the changes go into effect.
